A UAE residence permit does not answer every tax-residency question. If you plan to use a UAE Tax Residency Certificate abroad, establish both your UAE position and what the other country requires before relying on the certificate.

This is general information. Your CPA and counsel confirm the details for your case.

Three routes for natural persons

Cabinet Decision 85 of 2022, effective 1 March 2023, sets out alternative UAE tax-residency routes for individuals. One is having your usual or primary place of residence and the centre of your financial and personal interests in the UAE. That route concerns where your life is based, not just possession of an identity document. 1

A second route is physical presence in the UAE for at least 183 days during a consecutive 12-month period. Keep travel records that allow you to establish the relevant period and presence. 1

The third route involves at least 90 days during a consecutive 12-month period. You must also be a UAE national, hold a valid UAE residence permit or be a GCC national, and have a permanent residence in the UAE or carry on employment or business there. Ninety days by itself is not the complete test. 1

Start by identifying which route your actual circumstances support. Do not plan around a day count while leaving the accompanying conditions unresolved.

A company has a separate residency test

Under the same decision, a juridical person can be tax resident where it is incorporated, formed or recognised under UAE legislation, excluding a registered branch of a foreign company, or where it is resident under UAE tax legislation. Your personal residency and the company's position are separate questions. 1

Keep separate files for each. A company registration document does not tell the whole story of where you personally live, and your own residence permit does not substitute for the company's application evidence.

What the certificate application needs

The FTA's 2024 guidance identifies supporting documents for individuals applying on the 183-day basis: an Emirates ID and residence visa, or a passport with an ICP entry-and-exit report. For 90 to 182 days, additional evidence supports employment, business or a permanent home, such as a certified tenancy document. 2

Build the file around the route you are using. Put the travel record, identity documents and relevant home or work evidence together so the period and conditions can be assessed clearly.

The FTA's 2024 guidance says a certificate cannot cover a future period or a period longer than 12 months. An individual may apply for the current period once the criteria are met. Legal persons can apply three months into the relevant period; a newly incorporated entity without a corporate tax return must have been established for 12 months. 2

Those timing rules belong in your plan before you promise a certificate to a bank or another tax authority. A document for a past or qualifying current period cannot be treated as advance approval for a future year.

Application route and costs

The FTA's 2024 guidance places the Tax Residency Certificate application in EmaraTax under other services. It also describes a service for stamping foreign tax forms. Establish which document the receiving organisation actually needs before you apply. 2

The FTA's December 2025 fee schedule distinguishes submission, applicant categories and printed copies. Confirm the current figure for your category and requested documents. Avoid treating a service provider's total quote as if every item were an authority fee. 3

Another country applies its own treaty requirements

Cabinet Decision 85 states that the conditions of the relevant tax agreement govern treaty use. A UAE domestic-residency result therefore does not establish that every other country must give you the treatment you want. Identify the country, the income and the agreement before drawing a conclusion. 1

For US citizens, there is a specific limit to keep in view. The IRS treaty list updated in January 2026 does not include a US-UAE income tax treaty. IRS Publication 54 also explains that saving clauses generally preserve US taxation of citizens despite treaty provisions. A UAE certificate does not erase your US filing responsibilities. 4, 5

Talk to your CPA about the US filing position before changing how you report income. Keep the UAE residency evidence and the US compliance work connected, rather than treating the certificate as a replacement for either analysis.

What this means for you

A strong application starts with a purpose. You should know which period you need to document, which residency route you meet and who will receive the certificate. Then you can assemble evidence that answers the real question instead of collecting a document and hoping it produces a particular foreign tax result.

Common mistakes to avoid

  • Treating a residence permit as the complete tax-residency test.
  • Counting 90 days without checking the additional conditions.
  • Applying for a future period that the certificate cannot cover.
  • Mixing personal and company residency evidence.
  • Assuming every country accepts the certificate for the same purpose.

What to do this month

  • Identify the recipient and purpose of the certificate. Ask which period and document they need, including whether a foreign tax form requires stamping.
  • Reconcile your travel record with the period you intend to cover. Gather the identity, home, employment or business evidence relevant to your route.
  • Check the application timing and current fees for your category. Separate authority charges from any assistance included in a provider's quotation.
  • Map the cross-border question for your CPA and counsel. Specify the country and income involved so the review addresses the intended treaty or domestic-law treatment.

Where FNC fits

Your residency plan should align with how you live, where your business operates and how you bank.
